1. Scope of Work
Kirk Websites ("Developer") agrees to design and develop a website for the Client based on the project description, features, and price submitted with this agreement. Work outside the agreed scope may require additional fees, to be discussed and agreed upon before being performed.
2. Website Build Price & Payment
The Client agrees to pay the full one-time website design and build price listed in this agreement. Submitting the signed agreement opens a Square-hosted checkout. No card is charged until the Client reviews the amount and completes payment on Square.
3. Hosting & Monthly Care Services
Website hosting, maintenance, backups, security monitoring, ongoing support, and other monthly care services are separate recurring services unless the Client’s written quote specifically states otherwise. If a monthly care amount is entered in this agreement, Square collects the first monthly payment when the Client completes subscription checkout and automatically bills the same amount each month until canceled. If the field is blank, no Square subscription is created. Plans start at $35 per month and vary based on the website’s needs.
The monthly price may be adjusted if the Client later requests and approves upgrades, added features, integrations, increased storage or traffic capacity, enhanced security, or additional support. Kirk Websites will communicate any updated recurring price before billing the change.
The Client may request cancellation of monthly website care by contacting info@kirkwebsites.com. Cancellation affects future recurring billing according to the current billing period and does not cancel or refund the separate one-time website build payment.
4. Timeline
Work will begin once payment terms have been satisfied and any required materials (content, images, branding) have been provided by the Client. Delays in providing materials may extend the project timeline.
5. Revisions
The agreed price includes a reasonable number of revisions during development. Requests that substantially change the original scope may be treated as additional work.
6. Ownership
Upon receipt of full payment, ownership of the final delivered website transfers to the Client. Kirk Websites retains the right to display the completed project in its portfolio unless otherwise agreed in writing.
7. Cancellation
Either party may cancel the project in writing. Any payment for work already completed is non-refundable.
8. Limitation of Liability
Kirk Websites is not liable for indirect, incidental, or consequential damages arising from the use of the completed website.
This is a summary agreement template. A detailed, signed contract may be provided separately for larger projects.
